Terms Of Service Apex Towing · Towing, Recovery And Roadside Assistance · Broward County, Florida

Effective date: September 1, 2026

These terms govern towing, recovery and roadside assistance provided by Apex Towing, and your use of this website. Arrival times are estimates and are never guaranteed. Where a tow is a nonconsent removal from private property, county-set maximum rates apply and those rules override anything on this page that conflicts with them.

Service Terms And Scope

Section 1

Acceptance

By calling us for service, allowing us to perform work on or move a vehicle, or using this website, you agree to these terms. If you do not agree with them, do not use the service.

Section 2

Who We Are

Apex Towing provides towing, recovery and roadside assistance from 790 NW 1st Ave, Deerfield Beach, FL 33441, serving Broward County and Boca Raton, Florida.

Section 3

Services

We provide light, medium and heavy duty towing, vehicle recovery, roadside assistance and nonconsent removals from private property where properly authorized. We are not a repair shop and nothing we do at the roadside is a repair or a diagnosis of the vehicle.

Section 4

Arrival Times Are Estimates

Any arrival time given is an estimate based on where the nearest truck is at the time of the call, and is not a guarantee. Traffic, weather, scene conditions, access and other jobs in progress all affect it. Where an estimate is going to be missed by a material margin we will call you rather than leave you waiting.

We are not liable for losses arising from a delay in arrival, including missed appointments, storage charges accruing elsewhere, or consequential costs of any kind.

Section 5

Quotes And Pricing

Prices are quoted before dispatch based on the information you give us: the class of vehicle, the distance, the time of day and the nature of the job. A quote is only as accurate as the description it was based on.

If the job on arrival is materially different from the job described, it is re-quoted before work begins. You may decline the revised quote at that point. Charges may apply for a call-out where a truck has already attended, and any such charge will be stated when the revised quote is given.

Section 6

Parts And Materials

Where a job involves a part or consumable rather than only labor, that item is quoted separately from the service and both figures are given on the same call. Parts are not covered by the service price.

Section 7

Nonconsent Tows From Private Property

A nonconsent tow is a removal authorized by the property owner or their agent rather than by the vehicle owner. Maximum rates for nonconsent towing, storage and administrative fees are fixed by the county and no operator may charge above them. Broward County sets its own schedule by resolution of the Board; Boca Raton falls within Palm Beach County, which publishes a separate schedule. The applicable schedule is the one for the county in which the property sits.

Removals are performed only where the property has the posted notice signage required by Florida law and the removal has been authorized by a person with authority over the property.

Section 8

If You Reach The Vehicle Before It Is Removed

Where the vehicle owner or authorized driver arrives before a removal is complete, the vehicle is released. Under the Broward County ordinance no charge applies unless a complete mechanical connection has already been made, and where one has, the fee may not exceed one half of the posted rate for that tow. The posted rate is available on request at the scene.

Section 9

Vehicle Release

To collect a vehicle you must produce photo identification and evidence that you are entitled to the vehicle, such as the current registration or the title. Where the person collecting is not the registered owner, additional documentation may be required. Release is subject to payment of the amounts properly due.

Section 10

Storage

Where a vehicle is stored, storage charges accrue per twenty-four hour period. For nonconsent tows those charges may not exceed the maximum permitted by the applicable county schedule. Access to a stored vehicle is during the hours advised at the time and subject to the release requirements above.

Section 11

Personal Property In A Vehicle

Remove your belongings before a vehicle is towed wherever it is possible to do so. We are not responsible for personal property left in, on or attached to a vehicle , including cargo, tools, equipment, electronics and loose items, however caused, except to the extent liability cannot be excluded by law.

Section 12

Vehicle Condition And Damage Claims

Towing and recovery are performed with reasonable care using appropriate equipment for the vehicle. Some vehicles carry inherent risk, including those with low ground clearance, aftermarket bodywork, existing damage, corrosion, or non-functioning drivetrain, steering, brakes or suspension. Where a vehicle can only be moved by a method carrying that risk, we will say so before we begin.

Any claim for damage must be raised before the vehicle leaves our custody, or immediately on discovery and in any event within a reasonable period. Report it by calling the number on this page. Photographs taken at the time help everybody. We are not responsible for pre-existing damage or for damage arising from a condition you did not disclose.

Section 13

Payment

Payment is due as quoted at the time of the job unless other arrangements have been agreed in advance in writing. For account customers, terms are as agreed when the account is set up. We may withhold release of a vehicle until amounts properly due have been paid, to the extent the law allows.

If any payment request reaches you from a number other than (561) 873-7004, do not pay it. Call us on that number and confirm before sending money to anyone.

Section 14

Cancellation

Tell us as soon as possible if you no longer need the truck. Where a truck has already been dispatched or has arrived, a charge may apply, and it will be stated to you at the time rather than added afterwards.

Section 15

Your Responsibilities And Safety

You are responsible for giving accurate information about the vehicle, its location and its condition, and for your own safety while you wait. If anyone is injured or the vehicle is blocking a live lane, call 911 first. Stay clear of moving traffic. Do not attempt to move, load or assist with a vehicle at the scene.

You confirm that you are the owner of the vehicle or are authorized to instruct us in respect of it.

Section 16

Limitation Of Liability

To the fullest extent permitted by Florida law, our total liability arising out of or relating to any job is limited to the amount charged for that job. We are not liable for indirect, incidental, special or consequential losses, including loss of use, loss of income, or costs arising from delay.

Nothing in these terms limits liability that cannot be limited by law.

Section 17

Indemnity

Where you instruct us to remove a vehicle you do not own, including a removal from property you control, you agree to indemnify us against claims arising from that instruction, other than claims arising from our own negligence.

Section 18

Website Content

Information on this website is provided for general guidance. Rates set by county resolution change periodically, and the current published county schedule governs rather than anything stated here. We make no warranty that the site is error free or continuously available.

Section 19

Governing Law

These terms are governed by the laws of the State of Florida. Any dispute is subject to the exclusive jurisdiction of the state courts located in Broward County, Florida.

Section 20

Changes To These Terms

We may revise these terms. The version in force is the one posted here at the time the work is requested, carrying the effective date shown above.

Something Here Not Clear?

Call and ask before the truck rolls rather than afterwards. Our privacy policy covers information handling, and private property towing sets out the nonconsent rules in plainer language.
